DECREE OF THE MINISTER OF INDUSTRY AND TRADE

CONCERNING
THE APPOINTMENT OF SURVEYORS AS EXECUTORS OF VERIFICATION OR
TECHNICAL SURVEILLANCE OF IMPORT OF NITRO CELLULOSE

THE MINISTER OF INDUSTRY AND TRADE,

Considering:

• a. that in the framework of implementing Decree of the Minister of Industry and Trade No. 418/MPP/Kep/6/2003 on provisions on import of nitro cellulose (NC), it is deemed necessary to appoint surveyors as executors of verification or technical surveillance of import of nitro cellulose (NC);
• b. that in relation thereto, it is necessary to stipulate a decree of the Minister of Industry and Trade;

In view of:

Decree of the Minister of Industry and Trade No. 418/MPP/Kep/6/2003 on provisions on import of nitro cellulose (NC).

DECIDES:

To stipulate:

FIRST:

To appoint surveyors as executors of verification or technical surveillance of import of NC, namely:

• 1. PT Surveyor Indonesia; and
• 2. PT Superintending Company of Indonesia (PT Persero SUCOFINDO)

SECOND:

The two surveyors as meant in FIRST Dictum are assigned:

to verify or undertake technical surveillance, including data or information on:

• a. producer countries of goods;
• b. specifications of goods, covering HS numbers, description of goods and chemical composition;
• c. quantity and kind of goods;
• d. to contain results of the verification or technical surveillance as meant in point 1 into survey report used as import documents;
• e. to convey written report on verification or technical surveillance of NC periodically, every three months, to the Director General of Foreign Trade, Ministry of Industry and Trade, in this case the Director of Import.

THIRD:

In executing the verification and technical surveillance of import of NC, surveyors can collect compensation for services they render from importers of NC with the amount being adjusted to the principle of benefit.

FOURTH:

All costs arising from the issuance of this decree are borne by surveyors.

FIFTH:

The appointment of the surveyors as meant in FIRST Dictum shall not abolish the authority of the Minister of Industry and Trade to revoke, replace and supplement the appointment of surveyors as executors of verification and technical surveillance of import of NC.

SIXTH:

Technical matters related to the implementation of this decree shall be stipulated by the Director General of Foreign Trade.

SEVENTH:

This decree comes into force as from the date of stipulation.
